'Die zeitgenössische politische Theorie attestiert Verfassungen und Verfassungsgerichten integrative Leistungen. Diese resultiert aus einem Konsens, der bestimmte Bereiche, Aspekte, Werte, Prozeduren oder Normen einer Verfassung umschließen soll. Gleichwohl variieren die Vorstellungen davon, wie man Konsens erreichen kann, worauf er sich bezieht und wie der Konsensbereich begründet werden kann. Entlang dieser drei Fragen werden vier Modelle der Integration qua Wertehomogenität, qua Diskurs, qua Neutralität und qua Konflikt gebildet. Aufgrund von Defiziten in diesen Modellen wird in einem zweiten Schritt ein alternatives Modell präsentiert, das Integration als gesellschaftliche Selbstbeobachtung versteht. 'There is a widely shared notion within contemporary political theory that constitutions and judicial review foster the integration of modern democratic societies. Integration is mostly theorized as consensus with respect to certain values, procedures, and norms. Nevertheless, these theories vary significantly regarding three questions: 1. by which means can consensus be achieved? 2. which values, procedures and norms are objects of consensus? 3. how can consensus be justified on philosophical grounds? Four models of integration via constitution and judicial review will be presented in a first step. It is argued, that integration might be achieved via shared values, via discourse, via neutrality and via conflict. All four models explain a good deal of real-world integration. A few blind-spots still remain. An alternative model is presented in a second step. According to that model integration is best understood as a self-description of the members of the political community. Empirically, this model can be operationalized by discourse-analysis of decisions of a constitutional court.' (author's abstract)... view less
