Grenzen individueller Verantwortung

Abstract

"Auf die komplexen Verursachungs- und Verantwortungsverhältnisse in modernen Unternehmen wird zum einen mit der Forderung nach der Erweiterung der individuellen Verantwortung reagiert und zum anderen mit dem Vorschlag, das Unternehmen selbst als Verantwortungsträger zu behandeln. Beiden Konzepten ist gemeinsam, dass sie das Versagen alltäglicher und unkontroverser Verantwortungszuschreibungen an Individuen konstatieren. Dabei scheint die Leistungsfähigkeit dieser Zuschreibungspraxis jedoch häufig unterschätzt zu werden. Im folgenden sollen von Überlegungen Jaspers' ausgehend zwei unproblematische Formen individueller Verantwortung anhand zweier unternehmensethischer Beispiele und juristischer Überlegungen bestimmt werden. Damit soll ein Beitrag geleistet werden, um die Situationen, in denen kollektive Verantwortungszuschreibungen aufgrund des Versagens individueller Zuschreibungen pragmatisch sinnvoll sein könnten, einzugrenzen." "There are two strategies to cope with the complexities of modern corporations in dealing with responsibility-ascriptions. Some argue that individual moral responsibility should be enlarged, while others try to defend the concept of corporate responsibility. Both strategies assume the insufficiency of the standard model of individual responsibility in cases such as the Bhopal accident. However, this hypothesis rests on a simplified conception of individual responsibility. In this essay the author will, drawing on Jaspers, identify two forms of individual responsibility which are often neglected. This conceptual distinction will be applied to the case of I.G. Farben and the Bhopal accident. Hes aim is to show the efficiency of individual responsibility-ascriptions in studying such cases and, therefore, to argue against the widely held assumption that the standard conception of individual responsibility in modern corporations is inappropriate."
