Öffentlich-private Partnerschaften sind in der letzten Dekade vermehrt Untersuchungsgegenstand in der angelsächsischen, in den letzten Jahren auch in der deutschen Politikwissenschaft geworden. Dieser Artikel versucht, den parlamentarischen Kontrollanspruch und seine möglichen Grenzen bei diesem neuen Governance-Tool theoretisch und empirisch zu untersuchen. Dazu werden zunächst mögliche Konfliktstellen zwischen dem Recht auf Geheimhaltung privatwirtschaftlich handelnder Akteure und dem Kontrollanspruch des Parlaments herausgearbeitet. Im nächsten Schritt werden die relevanten Instrumente für die parlamentarische Kontrolle von ÖPP vorgestellt und nach ihrer empirischen Nutzung gefragt. Es kann aufgezeigt werden, dass es ein breites Spektrum von Kontrollinstrumenten gibt, die teilweise auch sehr intensiv genutzt werden. Jedoch stellt das Recht auf Geheimhaltung privater Akteure von Vertragsinhalten auch für die parlamentarische Kontrolle eine Grenze dar. In the past decade, public-private partnerships have been adapted as an alternative way of public procurement and service delivery in Germany, too. However, this hybrid tool of executive policy has challenged parliamentary scrutiny as a core function of the legislature, which has not yet been studied systematically. The article fills this gap in three steps. Firstly, it reconstructs theoretical tensions within public-private collaboration between the private partner’s right to confidentiality and the parliamentary need for scrutiny. In this section, publicprivate partnerships are also analysed as a special form of privatisation. Secondly, the article examines the parliamentary instruments relevant for scrutinizing the government’s policy on public-private partnerships as well as its empirical use. It can be shown that a broad spectrum of instruments has been used for addressing possible problems with PPPs. Finally, some lessons for strengthening the parliament‘s capability to scrutinize this new kind of cross-cutting policy instrument are drawn.... view less
