La protección social en la República Dominicana resulta de una combinación de programas de seguridad social en modalidades contributiva y no contributiva, regulaciones laborales en materia de estabilidad en el empleo y de salarios mínimos para un subconjunto de trabajadores, además de programas contra la pobreza. Las cotizaciones a la modalidad contributiva y los costos de la contratación formal varían según el sector y tamaño de las empresas. Sin embargo, los beneficio que reciben los trabajadores son inferiores a los costos, lo que genera incentivos en contra de la formalización y el crecimiento de las empresas. Por otro lado, los programas no contributivos subsidian el empleo informal. Esta combinación de políticas desalienta la productividad y las oportunidades para que los trabajadores dominicanos obtengan empleos con ingresos más altos, lo que a su vez impone un peso importante en programas compensatorios para las familias pobres. Más allá de las buenas intenciones, la superposición entre lo contributivo y lo no contributivo lleva a un equilibrio de baja efectividad de la protección, poca redistribución y baja productividad. La solución a este problema debe apuntar al foco de este, la legislación laboral. Esta fue importada de otras realidades hace muchas décadas y, en una medida importante, se incumple. Social protection in the Dominican Republic results from a combination of social security programs in contributory and non-contributory modalities, labor regulations regarding job stability and minimum wages for a subset of workers, as well as anti-poverty programs. The contributions to the contributory modality and the costs of formal contracting vary according to the sector and size of the companies. However, the benefits that workers receive are lower than the costs, which creates incentives against the formalization and growth of companies. On the other hand, non-contributory programs subsidize informal employment. This policy mix discourages productivity and opportunities for Dominican workers to obtain higher-income jobs, which in turn places a significant burden on compensatory programs for poor families. Beyond good intentions, the overlap between contributory and non-contributory leads to a balance of low protection effectiveness, little redistribution, and low productivity. The solution to this problem must point to the focus of this, the labor legislation. This was imported from other realities many decades ago and, to a significant extent, is breached.
