Racionalización formal del derecho moderno y justicia sustantiva: estudio crítico de la sociología jurídica de Max Weber

Abstract

Entre los diversos aportes teóricos que hicieron de Max Weber una de las figuras principales del pensamiento social del siglo XX, encontramos su sociología del derecho que tiene como tema el proceso de racionalización del derecho occidental. Max Weber estudió ese proceso como una racionalización de tipo formal que es acompañada, aún en su última etapa moderna, de tendencias contrarias que se dirigen hacia la materialización del derecho. A partir de estos trabajos de Weber se ha construido una crítica del Estado social y una oposición a tomar los derechos sociales como derechos fundamentales, consistentes en afirmar que tal proyecto político conspira contra las notas de racionalidad del Estado de derecho por implicar la introducción de exigencias materiales de justicia que degradan la norma superior del ordenamiento jurídico, es decir, la Constitución.

Among the various theoretical contributions that made Max Weber one of the main figures of social thought of the twentieth century, we find his sociology of law that has as its theme the process of rationalization of Western law. Max Weber studied this process as a formal rationalization that is accompanied, even in its last modern stage, by contrary tendencies that are directed towards the materialization of law. From these works of Weber, a critique of the social State and an opposition to taking social rights as fundamental rights have been constructed, consisting in affirming that such political project conspires against the rationality notes of the rule of law for implying the introduction of demands justice materials that degrade the higher norm of the legal system, that is, the Constitution.

Unter den verschiedenen theoretischen Beiträgen, die Max Weber zu einer der Hauptfiguren des sozialen Denkens des 20. Jahrhunderts gemacht haben, finden wir seine Rechtssoziologie, die den Prozess der Rationalisierung des westlichen Rechts zum Thema hat. Max Weber untersuchte diesen Prozess als eine formale Rationalisierung, die auch in ihrer letzten modernen Phase von gegenläufigen Tendenzen begleitet ist, die auf die Materialisierung des Rechts gerichtet sind. Aus diesen Werken Webers ist eine Kritik des Sozialstaates und eine Opposition gegen die Aufnahme sozialer Rechte als Grundrechte konstruiert worden, die darin besteht, zu behaupten, dass ein solches politisches Projekt gegen die rechtsstaatlichen Rationalitätsnotizen verstößt, um die Einführung von Forderungen zu implizieren Justizmaterialien, die die höhere Norm des Rechtssystems, dh die Verfassung, herabsetzen.
