¿En qué medida las leyes contra la difamación pueden afectar los contenidos de la prensa? ¿Qué factores favorecen que la prensa continúe con su labor crítica a pesar de la existencia de esta regulación restrictiva? Este artículo tiene como objetivo explicar las reacciones de la prensa frente al uso de las leyes de desacato como instrumentos de intimidación. Los resultados muestran que la crítica periodística sólo se desincentiva cuando están ausentes determinados actores capaces de fungir como aliados de la prensa, que provean recursos puntuales para resistir los embates de la manipulación. A partir del análisis de una base de datos original sobre el contenido de los principales diarios estatales mexicanos, se muestra que la existencia de un Poder Judicial independiente y una oposición parlamentaria vigorosa son condiciones necesarias para que la prensa crítica sobreviva.... view less

What effects do libel laws have over the press? Why do some media remain critical while others do not when facing repressive defamation legislation? This article aims to explain how the local press reacts to legal restrictions. The results show that the chilling effect caused by libel laws is conditioned by the context’s particularities: the critical function of the press may persist if strategic allies are present. Leaning on an original dataset on the content of the main Mexican newspapers of each state, it is argued that an independent judiciary and vigorous parliamentary opposition are key factors for the survival of a critical press.... view less
