Die Fortführung des Gründungsmoments in der Verfassungsordnung: Arendt, Jefferson und popular constitutionalism

Abstract

Entgegen der verbreiteten Rezeption von Arendts Idee der Fortführung des Gründungsmoments als radikaldemokratisches Konzept zeigt der Beitrag, dass ihre Adaption des römischen Gründungsbegriffs sie zu einem eher konservativen Verfassungsverständnis führt, das die Aufgabe der "Vermehrung" der Gründungsprinzipien primär der Judikative anstelle des Volkes überantwortet. Daher bleibt unklar, welche Legitimitätskriterien aus Arendts Gründungskonzept für eine Theorie der Verfassungsrevision abgeleitet werden können, was auch daran liegt, dass ihre Auseinandersetzung mit Thomas Jeffersons Antworten auf die Frage, wie eine Verfassung für Revisionen durch nachfolgende Generationen offen gehalten werden kann, lückenhaft ist. Es wird argumentiert, dass Jeffersons Idee 'periodischer Amendments', das von Arendt nicht diskutiert wird, wertvolle Impulse für eine republikanische Theorie der Kontinuierung des Gründungsmoments bietet, dass seine Verfassungstheorie jedoch insgesamt nicht geeignet ist, um Arendts Befürchtung, die Autorität des Rechts werde durch die Möglichkeit des Zugriffs des Volkes auf die Verfassung unterminiert, zu zerstreuen.

In contrast to widespread interpretations of Arendt’s theory of "refounding" as a radical democratic concept, this article shows that her adaptation of the Roman concept of founding leads her to adopt a rather conservative constitutional theory which places the authority for "augmenting" the founding principles primarily with the judiciary instead of the people. Therefore it is not clear what follows from Arendt's concept with regard to a theory of the constitutional amendment process. One reason for this deficit is her incomplete reconstruction of Thomas Jefferson’s answers to the question how a constitution can be held open for revisions implemented by later generations. It is argued that Jefferson’s concept of "periodical amendments", which is not mentioned by Arendt, has the potential to inspire a republican theory of the continuation of the founding moments, although Jefferson’s constitutional theory cannot adequately resolve Arendt's well-founded fear that the facilitation of popular revisions of the constitution will undermine law's authority.
