Después de examinar los objetivos y el nuevo dispositivo institucional creado a la luz de reforma energética de 2013-2014 para atender la problemática social vinculada con los proyectos de energía en comunidades y municipios, este artículo analiza las aportaciones y, sobre todo, las carencias de esta legislación en vista de sugerir algunas alternativas. Asimismo, pone en evidencia la naturaleza del problema de gobernabilidad que subyace tras la espiral de conflictividad que surge con la presencia de los desarrolladores en las comunidades. Como parte de una investigación más amplia, este trabajo utiliza las múltiples entrevistas a profundidad con diferentes grupos de actores (gubernamentales, empresas, comunidades, académicos, periodistas, consultores, etc.) para complementar la búsqueda hemerográfica realizada. La originalidad de este trabajo consiste en que: a) ofrece una visión histórica del nuevo andamiaje institucional para regular los impactos sociales (comparada con las graves deficiencias anteriores) y estudia las aportaciones de los cambios legislativos en derechos humanos, indígenas y responsabilidad social empresarial para la nueva regulación; b) muestra cómo la certeza jurídica que pretende brindar el nuevo marco regulatorio está in fine vinculada con el viejo problema de gobernabilidad que el país no ha logrado resolver hasta la fecha.... view less

Among its objectives and the new institutional framework that it has provided, the Mexican energy reform (2013-2014) has addressed social challenges related to energy projects in communities and municipalities. This paper discusses the prospects, and particularly, the existing gaps in legislation to propose alternatives. It has also underlined the nature of a governance problem that lies behind the social conflicts on the rise due to the intervention of developers among the communities. This article is part of a larger research project; in consequence, interviews in-depth were carried among different stakeholders (public and private sector, communities, scholars, journalists, consultants, etc.) to support the hemerographic sources. The original features of this essay is that: a) it provides an historical overview of the new institutional framework to adjust the social impacts (when compared to the previous serious flaws) and analyses the contributions of legislative changes within human rights, indigenous rights, and corporate social responsibility in the new regulation; b) it confirms how legal certainty, which the new institutional framework is intended to provide, is, in fine, associated with the age-old governance problem that Mexico has failed to solve so far.... view less
