'Seit rund 200 Jahren schwelt der Konflikt zwischen Rußland und Japan um die vier südlichen Kurilen-Inseln Kunashiri, Etorufu, Shikotan und Habomai. Der Inselgruppe, die in den letzten Tagen des Zweiten Weltkriegs von der Roten Armee Stalins besetzt wurde, kommt zwar nur geringe wirtschaftliche Bedeutung zu. Trotzdem belastet die ungelöste Territorialfrage bis heute das politische Klima zwischen der einstigen Supermacht Rußland und dem Wirtschaftsriesen Japan. Aufgrund seiner politischen Brisanz erscheint daher eine Analyse dieses rechtlich komplexen Disputs, insbesondere eine Klärung der völkerrechtlichen Zugehörigkeit der umstrittenen Inseln, erforderlich. Als Grundlage der Untersuchung dienen dabei vor allem die seit 1855 abgeschlossenen einschlägigen völkerrechtlichen Vertragswerke, unter denen der Friedensvertrag von San Francisco aus dem Jahre 1951 die heutige Rechtslage entscheidend determiniert.' 'The conflict between Russia and Japan over the four southernmost islands of the Kuril chain, Kunashiri, Etorufu (or Iturup), Shikotan and Habomai, has been smouldering for nigh on 200 years. The group of islands, occupied by Stalin's Red Army in the closing days of the Second World War, are of little economic significance. Nevertheless, the unresolved territorial dispute continues to sour the political climate between the former superpower Russia and the economic giant Japan to this day. In the light of the political incendiary potential of this issue, it would appear appropriate to conduct an analysis of this legally complex dispute and in particular to clarify the validity of the conflicting claims to the islands under international law. The study is based primarily on the pertinent international treaties concluded since 1855, of which the 1951 Peace Treaty of San Francisco essentially determines the present-day legal situation.'
