Pressefreiheit in Rußland: das Recht auf freien Zugang zu Information

Abstract

'Diese Arbeit untersucht, wie es in Rußland mit dem Recht auf freien Zugang zu Information bestellt ist, das neben dem Recht auf freie Informations- und Meinungsverbreitung ein Fundament der Pressefreiheit darstellt. Das Recht auf freien Zugang zu Information ist dem Recht auf freie Informationsverbreitung logisch vorgeordnet: Informationen und darauf fußende Meinungen können durch Medien erst verbreitet werden, wenn sie ihnen vorher zugänglich sind. Die maßgeblichen rechtlichen Normen über den freien Zugang der Medien zu Information werden der vielfach anzutreffenden Praxis der Informationsverweigerung und -selektion durch offizielle Stellen gegenübergestellt.' 'The situation in Russia regarding the right to free access to information forms the subject of this report. Alongside the right to free dissemination of information and opinions, the right to free access to information is one of the main pillars of press freedom. Free access to information is clearly a precondition for exercising the right to free dissemination of information, since the media can only disseminate information and opinion based on it if they have first gained access to it. The report contrasts existing legal provisions regarding media access to information with the authorities' frequent practice of either refusing to provide information at all or providing it in a selective manner.'
