Europäische Betriebsräte: eine Konstitutionsanalyse ; zur Genese und Dynamik transnationaler Arbeitsbeziehungen

Abstract

"Aus der Nachkonstruktion des Konstituierungsprozesses wird im folgenden die These entwickelt und begründet, dass der EBR sich dynamisch und tendenziell über die gesetzlichen Vorgaben ausbildet. Es wird gezeigt, wie und warum sich der EBR innerhalb einer Dekade von einem Informationsforum in Richtung eines Akteurs entwickeln konnte und wie sich hierbei eine 'interne' und 'externe' Dimension der Konstituierung wechselseitig beeinflusst haben. Die These eines zweifach determinierten, dynamischen Konstituierungsprozesses lautet mithin: Zwischen der Einrichtung von europäischen Informationsgremien auf freiwilliger Vereinbarungsbasis einerseits und der Verabschiedung und dem Wirksamwerden der Richtlinie andererseits besteht eine sich gegenseitig verstärkende Wechselwirkung. Dies betrifft zum einen die zahlenmäßige Verbreitung, wie die qualitative Ausformung der EBR. Ohne die ersten Pionierprojekte wäre es kaum möglich gewesen, den zur Verabschiedung der Richtlinie notwendigen gewerkschaftlichen und politischen Druck aufzubauen, die Anzahl verhandelter EBR zu vervielfachen und bis 1999 zu einer flächendeckenden Einrichtung von EBR zu kommen. Zum anderen hat die Praxis von EBR die prozeduralen Bestimmungen der Richtlinie in den freiwilligen Vereinbarungen vorweggenommen und dadurch letztlich erst ermöglicht." (Autorenreferat)

"This study traces the process leading to the constitution of European works councils and arrives at the conclusion that the dynamic activity of European works councils propels them beyond the legal framework originally established for them. The study shows how and why the European works council has been able, in the course of a decade, to develop from a function primarily of information exchange to an active role. Internal and external factors contributed to this change. A complex developmental dynamic has been at work here, between implementation by voluntary agreement on the one hand, and the passing legal provisions on the other. This dual dynamic has affected both the quantitative expansion of European works councils and their qualitative configuration. Without the initial pioneer projects it would not have been possible to mobilise the trade union and political pressure needed to secure passage of the EU guideline, and to multiply the number of negotiated European works councils as an institution throughout the EU by the year 1999. The actual practice of European works councils anticipated the procedural regulations of the EU guideline in the voluntary agreements thus ultimately making the regulations possible."
