'Der Beitrag gibt einen Überblick über rechtliche Regelungen zum islamischen Kopftuch in Europa. Dabei wird die Regelungssituation in den acht Vergleichsstaaten des EU-Forschungsprojekts VEIL skizziert und herausgearbeitet, dass der europäische Standard aus einer weitgehend toleranten regulativen Duldung des Kopftuchtragens in Schulen, Universitäten, im öffentlichen Dienst und auf den privaten Arbeitsmärkten besteht. Selektive Einschränkungen existieren allerdings ebenso wie eine Ablehnung weitergehender Verhüllung, insbesondere Gesichtsverschleierung. Abweichend regeln die streng säkularen, laizitären Staaten die Kopftuchmaterie. Deutliche regulative Abweichungen finden sich ebenfalls in einigen Bundesländern Deutschlands, wo das Kopftuchtragen für Lehrerinnen verboten ist. 'Regimes of Regulations Concerning the Muslim Headscarf in Europe: Standard and Deviation The article gives an overview over the legal regulations concerning the Muslim headscarf in Europe. In this context the setting of regulations in the eight countries of comparison within the perspective of the EU-project VEIL are portrayed. The European standard of regulation can be described as a rather tolerant dealing with the wearing of headscarves in schools, universities, in the public services and on the private labour markets. There are, however, selective restrictions and a common rejection of extensive veiling, especially face-veiling. Only the strictly secular, laic states regulate the issue in a divergent way. A clear departure from the standard we find in some federal states of Germany where teachers may not wear headscarves. The contribution tries to explain how and why this German deviation has been developed and how it should be assessed normatively.' (author's abstract)... view less
