| Abstract | Windkraftanlagen beeinträchtigen das Landschaftsbild zwangsläufig und ziehen damit automatisch die Aufmerksamkeit auf sich. Andere erneuerbare Energiequellen sind gewöhnlich nicht mit dieser Problematik so stark behaftet und kommen nicht mit dem § 35 BauGB (Privilegierung im Außenbereich) in Konflikt. Zur Steuerung der Windkraftnutzung muss auf regionalplanerische Instrumente (Vorbehalts-, Vorrang- oder Ausschlussgebiet) zurückgegriffen werden. Infolge der rechtlichen Beurteilung der raumplanerischen Konzepte zur Windenergienutzung wird diesen auf regionaler Ebene ein breiter Raum eingeräumt. Dieser Untersuchungsschwerpunkt wird im Hinblick auf die Energieversorgung und auf erneuerbare Energie eingangs in einen Gesamtzusammenhang gestellt, wie auch deren regionalwirtschaftliche Aspekte. Auch auf den rechtlichen Rahmen regionalplanerischer Konzepte und deren rechtliche Folgerungen bei der Nutzung von Windenergieanlagen im Außenbereich wird eingegangen. Wind farms inevitably affect the appearance of the landscape and thus automatically draw attention to themselves. Other sources of renewable energy do not generally suffer to the same extent from this problem and do not come into conflict with Article 35 of the German Federal Building Code (Building in the Undesignated Outlying Area). In order to regulate wind energy exploitation, use must be made of regional planning instruments (reserved function area, priority area and exclusion area). Following the legal assessment of the spatial planning concepts for wind energy use, a lot of space is devoted to these concepts at regional level. The topic is approached by initially placing it in its wider context, in relation to energy supply and renewable energy, as well as with reference to the regional economic aspects. The legal framework of regional planning concepts and their legal implications in relation to the use of wind farms in outlying areas are also examined. |
