Evaluation des Gesetzes zur Weiterentwicklung des Teilzeitrechts - Einführung einer Brückenteilzeit

Abstract

Mit diesem Forschungsbericht wurden die Neuregelungen im Teilzeit- und Befristungsgesetzes (TzBfG) evaluiert. Diese Neuregelungen umfassen die Einführung der Brückenteilzeit nach § 9 a TzBfG, die Änderungen bei der Arbeit auf Abruf nach § 12 TzBfG und der Darlegungs- und Erörterungspflicht nach § 9 TzBfG bzw. § 7 Abs. 2 TzBfG. Insbesondere wird überprüft, ob und inwieweit beabsichtigte Wirkungen der Neuregelungen erreicht werden - vor allem im Hinblick auf die Realisierung von Arbeitszeitpräferenzen sowie auf die Planungs- und Einkommenssicherheit von Arbeitnehmerinnen und Arbeitnehmern. Darüber hinaus wird auch die Akzeptanz und Praktikabilität der Neuregelungen evaluiert und es wird der Frage nachgegangen, in welchem Ausmaß die Brückenteilzeit als Sachgrund für befristete Einstellungen genutzt wird.

This study evaluates the new provisions of the Part-Time and Fixed-Term Employment Act (TzBfG) using a qualitative research design. These new provisions include, on the one hand, the introduction of "bridge part-time work" according to § 9a TzBfG, and, on the other hand, changes regarding "on-call work" according to § 12 TzBfG and regarding specific obligations according to § 9 TzBfG and § 7 (2) TzBfG, respectively. In particular, it will be examined whether and to what extent the intended effects of the new regulations are achieved - especially with regard to the practical realization of working time preferences and the planning and income security of employees. Furthermore, the acceptance and feasibility of the new regulations will be evaluated, and the question of the extent to which "bridge part-time work" is used as a justification for temporary employment will be examined.
