Der Bund besitzt nun die konkurrierende Gesetzgebungskompetenz, die Länder können davon abweichen. Seit der Vollregelung durch den Bund (ROG) im Jahr 2008 bestehen in Baden- Württemberg zwei Regelungsschichten: Das Bundesrecht und ergänzend das Landesplanungsrecht. Diese Schichtenfolge wird anhand der Zielabweichung offengelegt. Die Regionalplanung besitzt mittlerweile ein differenziertes Regelungsraster, das die kommunale Planungshoheit überlagert. Begrenzt wird die Reichweite der überörtlichen Planung durch die Eingangsschwelle der Regionalbedeutsamkeit, den Bestimmtheitsgrundsatz und das Verhältnismäßigkeitsgebot. § 1 IV BauGB formuliert: Bebauungspläne sind den Zielen der Raumordnung anzupassen. Das Anpassungsgebot hat das Bundesverwaltungsgericht in einer noch andauernden Rechtsprechungsserie fein justiert und scharf konturiert. Davon berichten die folgenden Zeilen, insbesondere anhand der Steuerung des Einzelhandels. Zudem wird erläutert, wie die Ziele der Raumordnung für die Zulassung von Einzelvorhaben im Innenbereich und im Außenbereich (§ 34 und § 35 BauGB) wirken. %X Since the Federalism Reform the law of town and country planning has changed. The Federation now has legislative powers and the states can deviate from these. Since the full regulation by the Federation (ROG) in 2008 there have been two regulative layers in Baden-Württemberg: the federal law and, as a supplement to this, the regional planning law. This layer sequence is disclosed on the basis of the target deviation. The regional planning agency has in the meantime a differentiated regulation grid that superimposes the local planning authority. The range of supraregional planning is restricted by the input threshold of the regional significance, the principle of clarity and the proportionality requirement. § 1 IV BauGB (Building Code) states the following: development plans are to be adapted to the objectives of town and country planning. The adaptation requirements have been finely tuned and clearly defined by the Bundesverwaltungsgericht (Federal Administrative Court) in a still ongoing jurisdiction series. The following lines report on this, in particular on the basis of controlling the retail trade.
