"Bei der Transformation der Arbeitsbeziehungen in den Ländern Mittel- und
Osteuropas geht es vorranging um die Frage, ob und inwieweit Anleihen bei
Systemen westlicher Industrieländer gemacht werden können. Die in der
Rechtsvergleichung bislang gewonnenen Erkenntnisse sind dazu angetan,
äußerst aufwendige und komplexe Verfahren nahezulegen. Hinsichtlich der
Übertragbarkeit einzelner Systemelemente ist zu größter Vorsicht zu
mahnen. Die Notwendigkeit, möglichst schnell funktionierende Strukturen
aufzubauen, zwingt jedoch, von dieser Idealvorstellung erhebliche
Abstriche zu machen. Erforderlich ist der Mut zum pragmatischen
Experiment. Die dabei auftauchenden Probleme werden in dem Beitrag ebenso
diskutiert wie die Rolle, die auf westliche Experten in diesem
Umstrukturierungsprozeß zukommt. Der Autor reflektiert insoweit seine

"The basic question in reference to the transformation of industrial
relations and labour law in Central and Eastern Europe is whether and in
how far systems of western industrialised countries may serve as a model.
The lesson of comparative law would be to proceed in a very complex and
time consuming way, remaining very cautious towards any attempt to
transfer elements of other systems. The need however, to build up
functioning structures as quickly as possible leaves no choice but to
reduce significantly this ideal approach. The courage to pragmatic
experiments is necessary. The problems arising in this context are
discussed in this contribution as well as the role of western experts in
this process of restructuration. In this respect the author reflects his
