In den Diskurs über eine notwendige Reform des Wohlfahrtstaats gerät Verwirrung durch den angeblichen Widerspruch von Gerechtigkeit und Effizienz. Soll dieses Dilemma überwunden werden, muss man zunächst klären, was mit Gerechtigkeit und Effizienz eingentlich gemeint ist. Zudem gilt es, die Gründe für einen angeblichen Widerspruch zu entlarven. Ein dritter Punkt betrifft den engen Zusammenhang zwischen der Natur des Menschen und individueller Verantwortung. Mit seiner neo-aristotelischen Legitimierung sozialer Rechte in Gestalt des Fähigkeits-Ansatzes schreibt A. Sen diese Idee fort, die übrigens das vergessene Paradigma des Naturrechts im wirtschaftlichen und ethischen Kontext neu belebt. "The discursive search for needful reforms of the welfare-state is upset by the pretended contradiction ofjustice and efficiency. A fruitful progress leading out of this dilemma depends first on a terminological consensus of what is meant by justice and efficiency. Secondly the reasons for the presumed contradiction are unmasked. The third step remembers the social-humanistic idea of a narrow link between human nature and a developed individual responsibility. The recently by A. Sen proposed capability approach continues that idea adding a neo-aristotelic legitimisation of social rights, which by the way reanimates the forgotten paradigm of natural law for the economic and ethic context. The pretended contradiction is removed by the pretended symbiosis of justice and efficiency." (author's abstract)... view less
