"Der kommunale Sektor ist in rasantem Umbruch: organisatorische und rechtliche Ausgliederungen von Dienstleistungseinheiten prägen das Bild. Im Ergebnis entsteht eine konzernartige Struktur, in der mehr oder weniger selbständige Verwaltungs- und Wirtschaftsbetriebe unter dem Dach eines "Konzerns Stadt" agieren. Die Position und Arbeit der betrieblichen Interessenvertretung ändert sich hierdurch in erheblichem Maße; etablierte Beteiligungsmuster und Akteursbeziehungen werden in Frage gestellt. Der Beitrag behandelt die organisatorischen Entwicklungen im kommunalen Sektor und stellt die rechtlichen Rahmenbedingungen der betrieblichen Mitbestimmung dar. Darauf aufbauend werden die Herausforderungen, mit denen die Arbeitnehmervertretungen konfrontiert sind, und die zu erwartenden Veränderungen der Arbeitsbeziehungen skizziert." "Currently the German municipalities are undergoing a fundamental restructuring. As a result of organisational and legal changes, a decentralised structure is developing, like that of the company in the private sector, but consisting of public and private organisations at the same time. This development has enormous consequences for the status and the activities of the works councils. Their traditional forms of action and industrial relations are brought into question. The article describes the organisational developments in the local government sector and shows the legal basis of employee participation. Considering this, the upcoming challenges for the works councils and the anticipated changes in the industrial relations are discussed." (author's abstract)... view less
