"Institutionalistische Ansätze des Vergleichs gehen meist von national einheitlichen Modellen industrieller Beziehungen aus. Der vorliegende Beitrag kritisiert diese Annahme. Im Rahmen eines interessen- sowie repräsentationstheoretischen Ansatzes untersucht er Wirtschaftssegmente 'jenseits der Norm'. Die empirische Studie in 29 deutschen und französischen Betrieben ergibt, dass in peripheren Mittelbetrieben mit ihrer oft stark informell geprägten sowie individualisierten Verhandlungskultur sowohl in Deutschland wie in Frankreich formale Institutionen betrieblicher Interessenvertretung häufig wenig Relevanz besitzen. Auch im prekären Dienstleistungsbereich weichen die Standards betrieblicher Demokratie häufig negativ von den gesetzlichen Vorgaben ab; die länderspezifischen gesetzlichen und kulturellen Verhältnisse machen hier jedoch einen Unterschied. Der deutsch-französische Vergleich betrieblichen Interessenhandelns 'jenseits der Norm' verdeutlicht damit, dass national einheitliche, gesetzliche Regelungen segmentspezifisch in sehr unterschiedlicher Weise umgesetzt werden. Die Vorstellung einheitlicher nationaler Institutionenmodelle sollte daher systematisch durch eine Perspektive der Segmentierung industrieller Beziehungen ergänzt, wenn nicht sogar ersetzt werden." "Institutionalist approaches to comparative employment relations usually adopt holistic national models of industrial relations. The article criticizes this idea by analyzing the workplace bargaining processes in 'irregular' economic sectors, that work 'outside the national norm': medium sized enterprises located in industrial periphery and workplaces in the precarious service sector. The research analyzes 29 German and French plants. The empirical data indicate that in medium sized peripheral enterprises bargaining culture is often highly informal and individualistic; formal institutions of interest representation thus make no big difference. However the national legal institutions and historically developed institutional culture make a difference in the sector of precarious service work. In summary the article shows that national legal systems are put into practice in very different ways depending on the economic sectors. Thus it proposes to complement or even to replace the idea of national holistic models of industrial relations systematically by a perspective of segmentation of industrial relations."
