Ausgleichszahlungen an Standortgemeinden - ein geeignetes Verhandlungsinstrument für den Netzausbau?

Abstract

Mit der Energiewende hat der Netzausbau an Bedeutung und Dringlichkeit gewonnen. Um die Akzeptanz der Trassenprojekte zu fördern, wurde 2011 ein rechtliches Instrument geschaffen, welches Ausgleichszahlungen an Standortgemeinden ermöglicht. Im vorliegenden Beitrag wird beleuchtet, inwiefern Ausgleichszahlungen verhandlungstheoretisch sinnvoll sind, welche rechtlichen Bedenken damit zusammenhängen und ob auf Basis bisheriger empirischer Ergebnisse eine akzeptanzsteigernde Wirkung von Ausgleichszahlungen beim Netzausbau erwartet werden kann.

Developing the power grid has become a top priority as part of the German energy transition. To further the acceptance of respective projects, a legal instrument which allows compensation payments to municipalities has been introduced in 2011. In the following article we will discuss the utility of compensation payments during negotiations as well as possible legal concerns. Moreover, we will consider previous empirical findings on the effect of compensation payments with regards to the acceptance of infrastructure projects.
