Familiennachzug in Deutschland: Kleinstudie IV im Rahmen des Europäischen Migrationsnetzwerks

Abstract

Die Studie behandelt vor allem die rechtlichen Aspekte des Familiennachzugs nach Deutschland und nimmt eine Analyse der verfügbaren Daten zum Umfang des Phänomens vor. Die rechtliche Situation wird entlang der europäischen Richtlinie zur Regelung der Familienzusammenführung 2003/86/EG betrachtet und bezieht bereits die Änderungen im Aufenthaltsgesetz mit ein, die sich durch das im August 2007 in Kraft getretene Richtlinienumsetzungsgesetz ergeben haben. Die quantitative Entwicklung des Familiennachzugs wird anhand der Daten aus der Visastatistik des Auswärtigen Amtes sowie des Ausländerzentralregisters analysiert. Der betrachtete Zeitraum umfasst die Jahre 2002 bis 2006. Der Bericht entstand als Länderstudie des deutschen nationalen Kontaktpunktes im Rahmen der europaweit angelegten Small Scale Study IV des Europäischen Migrationsnetzwerks (EMN) "Family Reunification".

The Working Paper as part of the Small-Scale Study IV "Family reunification in Germany" of the EMN deals with the legal aspects of family reunification to Germany and analyses the available data on the extent of the phenomenon. The legal situation is observed in accordance with Council Directive 2003/86/EC of 22 September 2003 on the right to family reunification, and already includes the amendments to the Residence Act which emerged with the Directive Transposition Act, which came into force in August 2007. The quantitative development of family reunification is analysed using the data from the visa statistics of the Federal Foreign Office, as well as those of the Central Register of Foreigners. The period under observation is 2002 to 2006.
