Die Europäische Aktiengesellschaft (lat. Societas Europaea, SE) ist die erste supranationale Unternehmensform im Europäischen Wirtschaftsraum. Im Zuge einer SE-Gründung verhandeln Management- und Arbeitnehmervertreter auch über die Einrichtung eines europäischen Vertretungsorgans oder Verfahrens zur Unterrichtung und Anhörung in grenzüberschreitenden Angelegenheiten. Vor diesem Hintergrund geht der Beitrag der Frage nach, inwiefern die SE-Gründungen zu neuen Formen der grenzüberschreitenden Kooperation von Arbeitnehmern in multinationalen Unternehmen beitragen. Es zeigt sich, dass die SE-Gründungen zu einer neuen Dynamik in der Verbreitung von europäischen Informations- und Konsultationsgremien führen, wobei allerdings die Handlungsmöglichkeiten und das Aktivitätsprofil der Gremien in den einzelnen Unternehmen stark variieren.... view less

The European Company (lat. Societas Europaea, SE) has been the first supranational corporate form in the European Economic Area. In the process of establishing an SE management and employee representatives, there has to be decided whether they will establish a European employee information and consultation body or procedure. Against this background, the article examines how the SE foundations contribute to new forms of cross-border cooperation of employees in European companies. It turns out that the SE leads to a new dynamic in the dissemination of European information and consultation bodies although the capacity for information and consultation and their level of activities vary considerably.... view less
