Die Souveränität des 'King-in-Parliament': ein Beitrag zur Geschichte politischer Kultur in England

Abstract

The article outlines the historical contours of the peculiar and long-lived conception of sovereignty in the English tradition: the ‘King-in-Parliament’. After fixing its duration from at least the 15th (John Fortescue) to the early 20th century (Albert V. Dicey), the article traces its development in the 16th century (Henry VIII, Christopher Saint German, Thomas Smith), the attack on it in the 17th century by royalist policies on the one hand, and by republican policies on the other, its classic formulation as a mixed constitution by William Blackstone in the 18th century, and the critique of David Hume, Jeremy Bentham, John Stuart Mill and Walter Bagehot. The conclusions concern the specifics of the English/British political culture and the need to analyze political culture in a time frame of longue durée.

Ziel des Aufsatzes ist es, die historischen Konturen der eigentümlichen und langlebigen englischen Souveränitätskonzeption des 'King-in-Parliament' nachzuzeichnen, beginnend mit John Fortescue im 15. Jahrhundert bis hin zu Albert V. Dicey im frühen 20. Jahrhundert. Die Entwicklung der Konzeption im 16. Jahrhundert wird gezeigt (Henry VIII., Christopher Saint German, Thomas Smith), wie auch, dass sie im 17. Jahrhundert von zwei Seiten her unter Druck gerät: durch royalistische und durch republikanische Strömungen. Ihre klassische Formulierung als Mischverfassung im 18. Jahrhundert durch William Blackstone wird rekonstruiert, und die Kritik von David Hume, Jeremy Bentham, John S. Mill und Walter Bagehot wird skizziert. Die Schlussfolgerungen betreffen einerseits Spezifika der englisch-britischen politischen Kultur und andererseits die Notwendigkeit, politische Kultur in einem Zeitrahmen der longue durée zu analysieren.
