A lo largo de las páginas que siguen se trata de mostrar la insuficiencia de la producción legislativa mexicana del siglo XIX -incluidos los antecedentes liberales españoles y los textos de la insurgencia- para ofrecer vías de solución al problema que entrañaba la plena incorporación del indígena, con el carácter de ciudadano, al nuevo modelo del Estado, basado en los principios del liberalismo político. Nunca se logró elevar al indígena a un plano de efectiva igualdad: lo impedía la existencia de una sociedad polarizada entre las clases privilegiadas y la masa indígena, y refractaria a la plasmación en hecho de un igualitarismo jurídico que siempre se mantuvo en un plano meramente formal. Convertidos por las leyes en ciudadanos, los indios no se hallaron en condiciones de aprovechar esa igualdad que les ofrecía el nuevo sistema de gobierno, porque partían de una posición de notable desventaja.... view less

The following pages try to show the inefficiency of the Mexican legislation production in the nineteen century -including the Spanish liberal precedings and the insurgent texts- to offer different ways of solution to the problem that contains the full indigenous incorporation, with a citizen condition, to the new model of State based on the political liberalism process. It was never success the indigenous elevation to an effective equality level: it was impeded by the existence of a polarized society between the privileged class and the indigenous mass, and opposed to make concrete a juridical equality that always kept in a formal level. Transformed by the laws in citizens, the indigenous were not in conditions to approve this juridical equality that offer them the new government system, because they were in a position of a remarkable disadvantage.... view less
