Der im Folgenden vorgestellte Fall gleicht dem Fall Mollath darin, dass falsche Gutachten zu Fehlurteilen führten. Diese hatten langjährige, rechtswidrige Freiheitsberaubung der Verurteilten zur Folge. Ich habe mir die Frage vorgelegt, ob es sich dabei um 'bedauerliche Einzelfälle', um Solitaires handelt. Die andere mögliche Antwort: Im strafprozessualen Feld bringen systemisch induzierte Einflüsse die Beteiligten von dem gesetzlich vorgeschriebenen wahrheitssuchenden Kurs ab. Diese 'herausragenden' Fälle unterscheiden sich von allen anderen darin, dass solche Einflüsse besonders zahlreich, kräftig und additiv wirken. The case, which is subject of this article, is similar to the Mollath-case insofar, as wrong expert opinions led to wrong judgements. The case, which is subject of this article, is similar to the Mollath-case insofar, as wrong expert opinions led to wrong judgements. In both cases these resulted in long, unlawful deprivation of liberty. I raise the question, if these cases are unfortunate exceptions, solitaires. The alternative answer is: in the field of criminal justice influences of systemic character cause the involved persons to deviate from the path of finding the truth, which is the path of the law. These prominent cases differ from other cases insofar, that such influences are especially numerous, strong and additive. This alternative hypothesis is far more plausible.... view less
