Abstract

"Anhand der Institution Europäischer Betriebsräte (EBR) wird die Frage nach dem Verhältnis von gesetzlicher und vertraglich vereinbarter Mitbestimmung diskutiert. In der Praxis haben sich unterschiedliche Typen herausgebildet: Von rein formal bestehenden symbolischen EBR, bis hin zu beteiligungsorientierten EBR. Diese haben sich zu Verhandlungspartnern gegenüber der Konzernleitung entwickelt. Gefragt wird, unter welchen Bedingungen Europäische Betriebsräte in die Lage versetzt werden, solche Verhandlungen abzuschließen." (Autorenreferat)

"Based on the institution of Europeans Works Councils (EWC) the question of the relationship of legally and contractually introduced participation is discussed. After the agreement on the EC guideline 95/45 Works Councils were introduced in several hundred Europe-wide enterprises. On paper they are equipped with information - and consulting rights. In practice different types have evolved. From purely symbolic EWC which have no meaning to EWC that really practise co-determination. These have developed into negotiating parties opposite management and already achieved broader co-determination agreements. The question is discussed, which conditions put works council representatives in the position to conclude such negotiations." (author's abstract)
