"Die Tarifabweichung als von den Tarifparteien legitimierte betriebliche Unterschreitung von Flächentarifvertragsnormen gehört zu den wichtigsten neueren Entwicklungen des deutschen Tarifsystems. Während die wilde Dezentralisierung durch die Betriebsparteien oder die Tarifflucht der Unternehmen unbestreitbar eine Erosion des Tarifsystems bedeuten, sind die Folgewirkungen der Tarifabweichung weniger eindeutig. Im Beitrag werden die Ergebnisse einer Untersuchung aller abweichenden Tarifvereinbarungen der Metall- und Elektroindustrie seit Abschluss des 'Pforzheimer Tarifvertrages' vorgestellt. Dabei wird herausgearbeitet, dass die Bewertung der Tarifabweichung entscheidend von der empirisch zu beantwortenden Frage abhängt, inwieweit sie von den Tarifparteien prozedural und inhaltlich kontrolliert werden kann. In der Metall- und Elektroindustrie konnte die gewerkschaftliche Kontrolle in beiden Dimensionen vertieft werden. Die wichtigsten Grundlagen dafür sind die Intensivierung der verbandlichen Koordinierung und die Stärkung der gewerkschaftlichen Organisationsmacht in der betriebsnahen Tarifpolitik. Die Tarifabweichung geht aber einher mit Veränderungen in der Architektur des Tarifsystems, der Handlungslogik der Tarifparteien und der Interaktionskultur der Konfliktpartnerschaft. "Deviant collective bargaining agreements defined as local shortfalls of the labor standards stipulated in multi-employer collective bargaining agreements are one of the most interesting recent developments in the German system of collective bargaining. While other developments like informal deviances agreed by plant level actors or the decreasing collective bargaining coverage are easy to assess as forms of erosion of the system of collective bargaining, the effects of deviant collective bargaining agreements are highly controversial. The article presents an analysis of the deviant agreements negotiated in the metalworking industry since the so called 'Pforzheimer Agreement' of 2004. The assessment of deviant agreements depends to a large extent on the problem of material and procedural control of deviances. In the metalworking industry the union has achieved important success in both respects. It was based on an improvement of associational articulation and the strengthening of union's organizational power in plant oriented collective bargaining. This success is coupled with fundamental changes concerning the architecture of the collective bargaining system, the logic of collective action and the culture of 'partnership in conflict'. Moreover, especially with respect to other industries and sectors, deviant agreements are far away from being a panacea for healing the problems of the system of collective bargaining."
