Umgang mit NATURA-2000-Gebieten bei Vorhaben der Landesentwicklung: dargestellt am Beispiel Berlin, Brandenburg, Mecklenburg-Vorpommern

Abstract

Das Verhältnis der Raumordnung zum europäischen Naturschutzrecht bedarf der Verbesserung. Das vorliegende Arbeitsmaterial der ARL zeigt auf, dass das Raumordnungsverfahren sehr gut geeignet ist, raumbedeutsame Pläne und Projekte im Rahmen einer "raumordnerischen" FFH- bzw. Vogelschutz-Verträglichkeitsprüfung auch auf ihre Vereinbarkeit mit den inhaltlichen Vorgaben des europäischen Naturschutzrechts hin zu untersuchen. Die meisten im Verhältnis des europäischen Naturschutzrechts zur Raumordnung auftretenden Probleme lassen sich mit relativ geringem Aufwand beheben. Auf der Grundlage dieser Erkenntnis werden in diesem Band Vorschläge zum Umgang mit Schutzgebietsausweisungen, zur Erstellung von Managementplänen und zur Durchführung von Raumordnungsverfahren erarbeitet.

The connection between spatial planning and the European nature conservation legislation needs to be improved. As it is shown in this paper, the spatial planning procedure is very suitable to examine spatially relevant plans and projects within the scope of a "spatially planning" FFH or bird preservation impact assessment also in regard to its compatibility with the specification as regards content of the European nature conservation legislations. Most of the problems arising out of the connection between the European nature conservation legislation and the spatial planning can be solved with relatively little effort. Insofar, proposals have been developed regarding the designation of areas, the elaboration of management plans, and the spatial planning procedure.
