Sanktionseinstellungen bei Jura-Studierenden im Wandel

Abstract

'Die Arbeit präsentiert Ergebnisse aus einer seit 1989 (seit 1993 in regelmäßigen Abständen) durchgeführten Befragung von Jura-Studienanfängern zu Sanktionsvorstellungen, Strafzweckpräferenzen und Kriminalitätswahrnehmung. Ab Mitte der 90er Jahre lässt sich ein erheblicher Anstieg der gemessenen Punitivität nachweisen, der sich nur sehr bedingt mit einer veränderten Wahrnehmung von Kriminalität als bedrohlich erklären lässt. Dies gibt zu Überlegungen Anlass, veränderte Punitivität u.a. als Reaktion auf allgemeine Verunsicherung durch gesamtgesellschaftliche und globale Veränderungen oder aber als 'Pendelschlag-Phänomen' zu interpretieren.' 'In this essay results are presented stemming from surveys conducted amongst law students immediately after they entered law school from the year 1989 onwards (since 1993 on a regular basis). The questionnaires addressed issues concerning the amount of punishment, the aims and objectives of punishment and the perception of criminality. The study shows that from the mid 1990s onwards there has been a considerable raise in the urge for punishment. This raise can only to a limited extent be related to a modified perception of criminality as threatening. As a result the risen urge for punishment can be explained as either a reaction to a common sense of uncertainty originating from social changes on a global level, or as the fall-back of a pendulum.'
