Ehe als Übergangsarbeitsmarkt?

Abstract

"Dieser Beitrag weist auf eine normative Diskrepanz hin, die zwischen dem anerkannten Grundsatz der Gleichberechtigung von Frauen und Männern auf der einen Seite und dem geschlechtsspezifisch benachteiligend wirkenden Prinzip der Ehegattensubsidiarität auf der anderen Seite besteht. Im ersten Kapitel wird der Widerspruch in der normativen Entwicklung der Gleichberechtigung einerseits und der Interpretation der verfassungsrechtlich geschützten Ehe andererseits herausgearbeitet, denn er konserviert ungeachtet geschlechtsneutraler Regelungen die tatsächliche Benachteiligung von Frauen. Das zweite Kapitel beschreibt anhand von Regelungsbeispielen die staatlich unterstützte Fortwirkung des traditionellen männlichen Ernährermodells im Steuer-, Familien- und Sozialleistungssystem und zeigt auf, daß auf diese Weise ein Double-Bind-Effekt institutionalisiert wird. Dieser erweckt den Eindruck, daß Frauen eine eigenständige Existenzsicherung nicht so nötig hätten wie Männer. Das dritte Kapitel beschäftigt sich mit der Notwendigkeit eines Umbaus des Systems der Existenzsicherung in Richtung auf eine konsequente Individualisierung, dabei wird die Frage erörtert, wie dies bei gleichbleibender Verfassungsinterpretation hinsichtlich der Ehe dennoch erreicht werden könnte. Das abschließende vierte Kapitel greift die Titelfrage wieder auf und skizziert, wie die Theorie der Übergangsarbeitsmärkte für die egalitätsförderliche Erwerbsintegration von Frauen nutzbar gemacht werden könnte." "In this article the author sets out to show the legal and ideological discrepancy between the principle of gender equality on one hand and the principle of subsidiarity in the relations between the state and married couples on the other. This principle disadvantages women in the system of labour, taxation and social security, although all the regulations are gender neutral by now. The German system of livelihood for the individual is still based on the traditional mutual entity of the couple, this figure prevents the livelihood of women from being consequently individualised. In the first chapter the author works out the discrepancy between the constitutional principle of gender equality and the continuing legal support for marriage as an important system of livelihood. The second chapter deals with various examples of the perpetuing existence of the male breadwinner model and thus shows how a double-bind-effect is established, because there is a common assumption that women do not need an autonomous and individual opportunity to earn their living as urgent as men do. In the third chapter the author argues for an egalitarian transformation of the system of livelihood in a consequently individualised manner and discuss the question how this development could be achieved, although the constitutional base of marriage will probably not be changed. The fourth and last chapter takes up the title question and outlines how the theory of transitional labour markets could be used in order to support a stronger participation of women in working life."
