Methoden werden üblicherweise gleichbedeutend, aber unreflektiert, als Verfahren bezeichnet. Der Aufsatz geht deshalb der Frage nach, was das Verfahrensförmige an Methoden ist, um daraus methodologische Konsequenzen zu ziehen. Am weitesten reflektiert ist der Verfahrensbegriff im Zusammenhang mit Recht und Politik, weshalb zunächst einflussreiche derartige Verfahrenskonzeptionen (LUHMANN, HABERMAS) rekapituliert werden. Dabei dominiert die Frage nach Legitimationsmöglichkeiten positiven Rechts durch Verfahren. Im Kontrast mit produktiv-technischen und wissenschaftlichen Verfahren werden daneben die konstitutiven und erkennenden Dimensionen deutlich. Vor diesem Hintergrund lassen sich allgemeine Funktionen und Strukturmerkmale von Verfahren in einem Modell zusammenführen. Exemplarisch wird die Einlösung eines solchen Modells am "parlamentarisch"-experimentellen Verfahren Bruno LATOURs demonstriert. Derart konkretisiert und erweitert sind Konsequenzen für die Verfahrensförmigkeit wissenschaftlichen Arbeitens, für eine prozedurale Methodologie, abzuleiten, die sich insbesondere mit den Begriffen Relationalität, Positivität, Rekonstruktion und Transdisziplinarität verbinden. Nicht zuletzt lässt sich auf diese Weise die Spaltung in quantitative versus qualitative Forschung auf interessante Weise umgehen. Schließlich bietet die prozedural fundierte Methodik auch kritisches Potenzial, insofern die Einhaltung beziehungsweise Nichteinhaltung des Verfahrens hinterfragt werden kann.... view less

The term procedure (Verfahren) is often used synonymously with method (Methode). In this article we ask two questions: (1) Why it is justified to use both terms in the same way? (2) What are the consequences if one understands methods as procedures? We begin the paper by considering influential theories in the fields of law and politics (LUHMANN, HABERMAS), because concepts of procedures are most reflected in these fields. The focus is on legitimacy of legal and political norms and procedural decisions. Contrasting other kinds of procedures, e.g. economic and scientific ones, it should be possible to identify further dimensions beyond legitimacy, namely constitution and knowledge. This makes it possible to develop a general model which joins basic functions and structural characteristics of procedures. The "political" experimental procedure, developed by Bruno LATOUR, will be discussed as it exemplifies the general model. Thus illustrated and expanded consequences of the procedurality of scientific work, i.e. to a procedural methodology, will be derived. Following these arguments another perspective on terms like relationality, positivity, reconstruction, and transdisciplinarity would then be open for discussion. Moreover the distinction between qualitative and quantitative research approaches could be avoided. El término procedimiento (Verfahren) se utiliza a menudo como sinónimo de método (Methode). En este artículo vamos hacer dos preguntas: (1) ¿Por qué está justificado el uso de ambos términos en la misma forma? (2) ¿Cuáles son las consecuencias si se entiende a los métodos como procedimientos? Comenzamos el artículo al considerar las influyentes teorías en los ámbitos del derecho y la política (LUHMANN, HABERMAS), porque los conceptos de procedimientos se reflejan predominantemente en estos campos. La atención se centra en la legitimidad de las normas jurídicas y políticas y de las decisiones de procedimiento. En contraste con otros tipos de procedimientos, por ejemplo, los económicos y científicos, debe ser posible identificar más dimensiones más allá de la legitimidad, digamos, la constitución y el conocimiento. Esto hace posible desarrollar un modelo general que une las funciones básicas y las características estructurales de los procedimientos. El procedimiento experimental "político", desarrollado por Bruno LATOUR, se discutirá como ejemplo del modelo general. Así, se muestran las consecuencias ilustradas y ampliadas de la procedimentalidad del trabajo científico, por ejemplo, para un proceso metodológico. A partir de estos argumentos se abrirá a la discusión otro punto de vista en términos como relacionalidad, positividad, reconstrucción y transdisciplinariedad. Además, la distinción entre los enfoques de investigación cualitativa y cuantitativa podría evitarse. Eventualmente, un método basado en el procedimiento ofrece un potencial crítico, ya que permite la consideración del seguimiento o desobediencia de los procedimientos.... view less
