Politikverflechtung als Funktionsvoraussetzung des Bundesstaates? Zum Umgang mit dem Faktischen in der deutschen Föderalismusdiskussion

Abstract

Das Schlagwort von der "Politikverflechtung" steht als Synonym für den vermeintlich reformunfähigen Föderalismus in der Bundesrepublik. Zentrale Kategorien der politischen und wissenschaftlichen Debatte sind "Effizienz" und "Entflechtung". Die Tatsache, dass in der Verfassungspraxis aber ständig neue Verflechtungs- und Mischfinanzierungsformen entstehen, führt zu der These, dass Politikverflechtung ein konstitutives Merkmal von Bundesstaatlichkeit darstellt. Die Anerkennung dieses Faktums - unter Rückbesinnung auf das ursprüngliche Verflechtungstheorem von Scharpf, Reissert und Schnabel von 1976 - eröffnet neue Perspektiven für die dringend erforderliche Neuausrichtung der Reformdebatte.

The catch-word of "Politikverflechtung" ("joint decision making") stands synonymous with the frequently criticized reform resistance of German federalism. The central categories of the political and academic debate are "efficiency" and "entanglement" ("Entflechtung"). Besides these postulations the political reality is shaped by the permanent development of new cooperation and mixed financing structures of the Bund and the Länder, which stands in a clear contradiction to these dominant theoretical paradigms. This leads us to the thesis that joint decision making is a constitutional characteristic of federal systems. In acknowledging this fact the reform debate could be opened for new perspectives.
