'Die EU-Entscheidungsfindung auf höchster politischer Ebene wird hinsichtlich des Mangels an demokratischer Legitimität (input-Legitimität) und Effizienz (output-Legitimität) kritisiert. Der Konventsprozess zur Erarbeitung der 'EU-Grundrechtscharta' (2000) erwies sich allerdings als sowohl effektives als auch demokratisch gestärktes Entscheidungsverfahren. Eine vergleichende policy-Netzwerk-Analyse zwischen dem Konventsprozess und jenem Verhandlungsprozess zur Vorläuferin der Grundrechtscharta, der 'Gemeinschaftscharta für die sozialen Rechte der ArbeitnehmerInnen' (1989) auf Basis von Dokumentenanalyse und Experteninterviews soll das Legitimitätspotential des Konventsprozesses überprüfen und erklären. Aus konstruktivistisch-institutionalistischer Perspektive zeigt der Vergleich, dass der Einfluss spezifischer institutioneller Charakteristika des Konventsprozesses, welche die Veränderung von Akteurspositionen bewirkten, für dessen höhere output-Legitimität verantwortlich ist. Deliberation, Inklusion und Transparenz ermöglichten eine weitreichende Konsenslösung. Gemessen am Konzept deliberativer Demokratie ist die demokratische Qualität des Konvents jedoch ambivalent zu beurteilen. 'This contribution asks for ways of enhancing the legitimacy of EU decision-making at the highest political level. The convention process to the EU fundamental rights charter (2000) has been repeatedly highlighted as being particularly effective and democratic. A comparative policy-network-analysis on the convention process and the policy process leading to its predecessor, the community's social rights charter (1989), is conducted on the basis of document analysis and expert-interviews. From a constructivist-institutionalist perspective, the specific institutional characteristics which led to the change of actors positions in the convention process show to be responsible for its higher output-legitimacy. Deliberation, inclusion and transparency played an important role. However, referring to the concept of democratic legitimacy, the convention process shows ambivalent results. The convention clearly shows stronger patterns of democratic legitimacy than its precursor. Nevertheless, in both charter processes, efficiency is based on informal network governance. The trade-off between input- and output-legitimacy has not vanished in the convention model.' (author's abstract)... view less
