"In diesem Beitrag führen wir mit 'konstituierender Autorität' einen neuen Grundbegriff für die Internationale Politische Theorie ein, der es dem noch jungen Forschungsfeld ermöglichen soll, die Defizite des Moralismus, der naturrechtlichen Expertokratie und der Orientierung an etatistischen Demokratievorstellungen zu überwinden. Unter konstituierender Autorität verstehen wir die legitime Ausübung verfassunggebender Gewalt in Prozessen, in denen staatliche oder überstaatliche politische Ordnungen begründet oder transformiert werden. Im Rückgriff auf John Locke argumentieren wir, dass mit jeder innerstaatlichen Verfassunggebung unweigerlich die Grundlagen für zwischenstaatliche Verrechtlichung geschaffen werden. In diesem Sinn sind staatliche und überstaatliche Gründungsmacht gleichursprünglich. Wir illustrieren das Potenzial unseres konzeptionellen Vorschlags anhand der Debatten über die politische Form der EU, die Zusammensetzung grenzüberschreitender demoi und die Legitimität internationaler Gerichte." "In this contribution, we put forward constituent authority as a basic concept of International Political Theory. The concept is to enable the developing research field to overcome the deficits of moralism, natural law expertocracy, and its orientation towards statist notions of democracy. By constituent authority we understand the legitimate exercise of constituent power in processes in which state as well as supra-state political orders are founded or transformed. Drawing on John Locke, we argue that any constitution-making act at the state level inevitably creates the foundations for a juridical condition among states. In that sense, manifestations of constituent power at the state and the supra-state level are co-original. We illustrate our proposal's potential with regard to contemporary problems by reference to the debates about the political form of the EU, the composition of border-crossing demoi, and the legitimacy of international courts."
