"Vor dem Hintergrund des demographischen Wandels in westlichen Gesellschaften werden große Hoffnungen in assistive Technologien im Bereich der Altenpflege gesetzt: 'Ambient Assisted Living' (AAL)-Systeme sollen die Kosten von Pflegedienstleistungen dämpfen und die Chancen auf ein selbstbestimmtes Leben im Alter verbessern. Dieser Beitrag beleuchtet anhand der Situation in Österreich rechtliche Herausforderungen solcher unterstützenden Anwendungen. Ausgehend von theoretischen Überlegungen zur normativen Wirkung 'intelligenter' Algorithmen stellen wir rechtliche Problemwahrnehmungen relevanter Akteure im AAL-Feld vor. Dabei zeigen sich insbesondere in Bezug auf Haftungsfragen beträchtliche Unsicherheiten. Abschließend diskutieren wir diese Ergebnisse unter Gesichtspunkten der Actor Network Theory und des Rechtspluralismus. Eine angemessene rechtliche Regulierung sollte, so unser Argument, nicht nur die Perspektive Betroffener miteinbeziehen, sondern auch in der Lage sein, die Inhalte technischer Programmierungen zu beeinflussen." "Against the background of the demographic change in Western societies, hopes focus on assistive technologies in elder care: 'ambient assisted living' (AAL) systems are supposed to curb the costs of care services and to enhance the chances for a self-determined living in seniority. With regard to the situation in Austria, this article highlights legal challenges of such supportive applications. Based on the theoretical assumptions for the normative effect of 'intelligent' algorithms, we present legal problem perceptions of relevant players in the field of AAL. Considerable uncertainties appear especially with reference to questions of liability. Finally, we discuss these findings in terms of actor network theory and legal pluralism. We argue that an adequate legal regulation should not only include the perspective of persons concerned, but should also be able to influence the contents of technical coding."
