Die Entsenderichtlinie: Entscheidungsprozeß und Rückkopplungen im Mehrebenensystem

Abstract

"Mit der Internationalisierung der Wirtschaft, die mit der Einführung des europäischen Binnenmarktes zusätzlich gefördert wird, steigt der freie Dienstleistungsverkehr an. Aus diesem Grund beobachten wir derzeit besonders im Bausektor Migrationsströme von Niedrig- in Hochlohnländer, wie z.B. Deutschland. Angesichts der zunehmenden Zahl von entsendeten Arbeitnehmern befürchten die Gewerkschaften und Arbeitgeberverbände der Zielländer der Entsendung Soziales Dumping und den Verlust an Wettbewerbsfähigkeit. Der Beitrag zeigt auf, wie die relevanten Akteure auf der europäischen wie nationalen Ebene auf die Entsendungspraxis reagiert haben. Im ersten Teil wird der politische Entscheidungsprozeß in der EU und der Soziale Dialog des Bausektors als ein Instrument zur Beeinflussung des Entscheidungsprozesses analysiert. Der zweite Teil Beschreibt Rückkopplungsprozesse zwischen den Ebenen und zeigt, daß der Kompromiß hinsichtlich der Entsenderichtlinie aus Rückkopplungsprozessen im Mehrebenensystem resultiert." "As national economies become increasingly interdependent, especially with the introduction of the single European market, the free movement of workers and services increases. For that reason, especially in the construction sector, we observe a migration from low wage countries to high wage countries such as Germany. In view of the increasing number of posted workers, the trade unions and the employer organisations in high wage countries fear social dumping and a loss of competitiveness. The article shows how the relevant actors at the European and national levels have dealt with the posting of workers. In the first part, it analyses the political decision-making process within the European Union and the social dialogue of the contruction sector as an instrument to influence the decision-making process. The second part deals with feedback processes between the European and the national levels. Finally the article argues that the compromise concerning the posted workers directive is the result of feeedback processes in a multilevel system of governance." (author's abstract)
