"Die turbulente Transformationsphase auf dem Arbeitsmarkt der fünf neuen Bundesländer wird im vorliegenden Beitrag dazu genutzt, die Rolle der Arbeitsgerichtsbarkeit im deutschen System der industriellen Beziehungen herauszuarbeiten: In der Transformation mussten die Gerichte erstens Lücken, die im Arbeitsvertrag durch Übergangsprobleme aufgerissen worden waren, verbindlich ausfüllen und so die Rechtsunsicherheit reduzieren. Zweitens stellten die Arbeitsgerichte ein faires, die verbreitete Unzufriedenheit kanalisierendes Verfahren zur Beilegung von Konflikten bereit. Es wird weiter empirisch gezeigt, dass Kündigungsschutz- und Entgeltklagen in den neuen Ländern noch immer häufiger sind als in den alten Bundesländern und dass die angespanntere Arbeitsmarktlage in Ostdeutschland dies nur partiell erklären kann. Dies dürfte auf die Schwäche kollektiver Arbeitnehmervertretungen in Ostdeutschland zurückzuführen sein. Da Gewerkschaften und Betriebsräte auch in den alten Bundesländern in die Defensive geraten sind, dürfte auch dort die Bedeutung von Arbeitsrechtsprechung zur Konfliktregulierung künftig noch wachsen." "This paper takes the transformation of eastern German labour markets since 1989 to identify the role of labour court litigation within the German system of industrial relations: First, court rulings had to complete gaps in the labour contract, which had emerged during the transition period, and hence reduce legal uncertainty. Second, the labour courts provided a fair procedure for employees to voice their widespread discontent. Today, the propensity to take legal action over dismissals and pay before labour courts is still higher among eastern German employees, compared with their western German counterparts. As is shown via regression analysis, this finding can be explained only in part by diverging labour market conditions. It is argued that the relative weakness of trade unions and works councils in eastern Germany explains why eastern German employees still use the labour courts more often. Since trade unions and works councils are also on the defensive in western Germany, the importance of labour court litigation is likely to increase in the future." (author's abstract)... view less
