"Der Artikel informiert über die wichtigsten Änderungen, die das Gesetz zur Reform der Betriebsverfassung gebracht hat. Diese konzentrieren sich auf die organisatorische Seite, während die Mitbestimmungsrechte nur marginale Erweiterungen erfahren haben. Der Verfasser versucht, die Bescheidenheit der Reform mit der (Macht-)Position der Akteure Gewerkschaften, Regierung und Arbeitgeberverbände zu erklären. Durch geschickteres Gesetzgebungsmanagement wären nur kleinere Verbesserungen möglich gewesen. Für die Zukunft der industriellen Beziehungen ist bedeutsam, dass durch Tarifvertrag, evtl. auch durch Betriebsvereinbarung, eine unternehmens- und konzernübergreifende Parallelstruktur zur Gewerkschaft geschaffen werden kann." "This article describes the most important modifications which the Works Constitution Reform Act of 2001 has made to the existing system of workers' representation. The new law concentrates on the way works councils can be organized, but puts almost no emphasis on the enlargement of codetermination rights. The author explains the modesty of the reform by the power of the key institutional actors: Unions, Government and Employers´ Associations. A better management of the legislative process would have produced only small improvements. For the future of industrial relations, it is significant that the new law makes it possible to establish committees that span the frontiers of individual enterprises and which may fulfil trade union functions."
