"Im vorliegenden Beitrag werden zunächst die Grundbausteine des Tarifvertragsrechts in Österreich und Italien dargestellt. Auf dieser Grundlage wird sodann geprüft, inwieweit das Tarifvertragsrecht in den beiden Ländern Flexibilisierungen von arbeitsrechtlichen Normen und Arbeitsbedingungen ermöglicht. Hierbei werden die Themenbereiche 'Tarifautonomie und Günstigkeitsprinzip' 'Tarifautonomie und Betriebsautonomie' sowie 'Tarifautonomie und Arbeitsmarkt' vertieft. Wesentliches Ergebnis ist, dass in Österreich eine durch Tarnertrag erfolgende Flexibilisierung des Arbeitsrechts wegen der gesetzlichen Privilegierung der Tarifautonomie gegenüber der Betriebsautonomie und wegen des Primats des Gesetzes bei der Regelung der Rechte und Pflichten der Arbeitsvertragsparteien nur in beschränktem Maße möglich ist. Doch ist dem österreichischen System zu bescheinigen, dass es klare Grundsätze und Kompetenzzuweisungen kennt, die das Handeln der sozialen Akteure berechenbar machen und (möglichen) Konflikten bereits im Vorfeld vorbeugen. Das Fehlen einer systematischen gesetzlichen Regelung des Tarifrechts in Italien schafft hingegen zahlreiche rechtliche Probleme und birgt ein nicht zu unterschätzendes Konfliktpotential. Andererseits bietet dieses System den Vorteil, dass die Tarifparteien in weitergehendem Ausmaß flexible Lösungen schaffen können, wo sie es für tarifpolitisch zweckmäßig halten. "This article begins by describing the basic elements of the law of collective agreements in Austria and in Italy. On this basis, it considers, to what extent the law of collective agreements allows the flexibilisation of employment law and the working conditions in both countries. In this connection, it develops the themes of 'autonomy in collective bargaining and favourability principle', 'autonomy in collective bargaining and autonomy of bargaining in the establishment' as well as 'autonomy in collective bargaining and labour market'. The essential result is, that in Austria the flexibilisation of employment law through collective agreements is restrained by the primacy of the law regulating the rights and duties of the contracting parties. But it can be shown that the Austrian system is endowed with clean principles and a clean allocation of competences, which make the actions of the social partners calculable and which help to prevent potential conflicts. In contrast, the absence of a systematic legal regulation of collective labour law in Italy creates numerous legal problems and contains a potential for conflict which should not he underestimated. However this system offers the advantage of providing flexible solutions for the parties to a collective agreement in a more extensive way, in so far as they consider this appropriate."
