"Der Artikel behandelt die Legalisierung der 24-Stunden-Betreuung in Österreich. Die Ausgangslage, die rechtlichen Veränderungen und die Auswirkungen für die Pflegekräfte werden analysiert. Die Fragestellung betrifft die sozialen Rechte, die den 24-Stunden-PflegerInnen zu- oder aberkannt werden. Gefragt wird, ob die Regulierung der 24-Stunden-Pflege als Fortschritt in dieser Hinsicht zu werten ist. Der Artikel kommt zu einem anderen Schluss: Vielmehr wurde die Rechtslage der gängigen Praxis der 24-Stunden-Pflege angepasst. Die Arbeitsbedingungen bleiben daher für die Pflegekräfte äußerst prekär. Grundlage des Beitrags ist eine Politikfeldanalyse mittels ExpertInneninterviews, qualitativen Interviews, Literatur-, Medien- und Dokumentenanalyse, die im Rahmen der Dissertation 'Der irreguläre Pflegearbeitsmarkt. "This paper deals with the legalization of the so called 24-hour care in Austria. It provides answers to the question, to which extent the new laws represent a progress in terms of social rights and inclusion into the labour market for the care workers? The article concludes that the new laws, related to the regulation of the migrant care work, are only little more than an adjustment that permits the preservation and continuation of the existing system. The working conditions continue to be precarious and casualised. Casualisation is fostered by the legal facilitation of self-employment for 24-hour care, thus undermining efforts to standardize normal employment in this sector of care work. The article is based on (1) a policy analysis by means of qualitative interviews with experts in the related fields, care workers, agents of care work, care dependents and their relatives, and (2) a media and document analysis that was being conducted in the framework of the dissertation 'Undocumented Migrant Labour in the At-Home Elderly Care.
