"Die Aufnahme von Aussiedlern in Deutschland erfolgt in einem statusrechtlichen Anerkennungsverfahren. Der vorliegende Aufsatz untersucht das Institut der Aussiedlerberatung als einen Anwendungskontext der statusrechtlichen Regularien des BVFG (Bundesvertriebenen- und Flüchtlingsgesetz). Analysiert wird ein Beratungsgespräch, in dem ein Aussiedlerehepaar aus der ehemaligen Sowjetunion einen Berater ersucht, bei der Abfassung eines Widerspruchs gegen den nachteiligen Anerkennungsbescheid für den Ehemann (Anerkennung nach Paragr. 7, 2 BVFG) behilflich zu sein. Nach einem kurzen Überblick über den konzeptuellen Rahmen zur Analyse von Beratungsgesprächen wird gezeigt, wie das kommunikative Verhalten des Aussiedlerehepaares auf das wichtige Anerkennungsmerkmal 'Kenntnisse der deutschen Sprache' zugeschnitten wird. Anschließend werden die beraterseitigen Verarbeitungsstrategien des Klientenanliegens herausgearbeitet (präjudizielle Fallaufnahme; ambivalente Bearbeitungszusagen; Beurteilung des Klientenverhaltens in der Logik einer absoluten Aussiedlungsmoral). "This paper deals with certain phenomena in counselling encounters with persons who are categorized as 'Aussiedler': persons who are regarded as members of the collectivity of Germans and who have migrated to Germany after leaving their home territories in Middle and Eastern Europe and especially the former Soviet Union. In the last decades this has been a mass movement. According to legal regulations members of the collectivity of Germans are persons who have stood by their German nationality in their home countries and whose claim to membership has been confirmed by certain characteristics like German descent and the mastery of the German language. As one might expect, this claim to membership is often put into doubt by members of the public and by institutions. The admission of „Aussiedlern“ to Germany takes place within a legal status acknowledgement procedure. Above all, not being officially recognized as an 'Aussiedler' invalidates claims for specific support and benefits. This paper analyses how the legal status regulations (of the 'Bundesvertriebenengesetz') have their impact on what is happening in counselling encounters with such migrants. Based on the transcriptions of one counselling encounter I demonstrate how the communicative behaviour of the clients (a married couple from the former Soviet Union) reveals their orientation and adaption to the legal status feature of 'knowledge of the German language.' The analysis makes visible how the counsellor deals with the couple’s request to take action against the husband's unfavourable status designation because of his supposed lack of German language skills. Based on such a case analysis it becomes possible to discover potential crises and disruptions which are typical for such counselling encounters.
