Der Beitrag gibt einen Überblick über die Geschichte der Denunziation vom mittelalterlichen Kirchenrecht über die Periode der Aufklärung bis zum Nationalsozialismus. Der Autor entwirft darin ein Design, das die Bedeutung horizontaler und vertikaler Loyalitäten unterstreicht und denunziatorisches Verhalten in historisch-gesellschaftliche Kontexte einbindet. Was das 'Institut der Denunziation' für den Autor so gefährlich macht, ist, dass wir alle, als Täter wie Opfer, 'schon von Haus aus denunziationsgefährdet sind'. Die Verführung der Nähe und Teilhabe an der Macht zeigt sich schon bei der Denunziationen des Geschwisters beim Vater oder bei der Mutter. Jeder von uns kann daher zur Gewinnung der Autonomie auf einen 'Urverrat' zurückblicken. Hier sieht der Autor einen tiefenpsychologischen und lebensgeschichtlichen Hintergrund, warum Denunziation in der Erwachsenenwelt, namentlich im Recht, so wirkungsmächtig ist und bleibt. 'Inevitably, the term 'denunciation' evokes negative sensations. One is reminded of the prosecution of witches, heretics, or of the methods of secret police. Nevertheless, a more rational consideration will prove that denunciation also had its positive aspects. In a juridical context denouncing appears whenever offences are prosecuted by authorities ex officio. The emergence of denunciation as a legal institut is connected with the 'criminal procedure revolution' under pope Innocent III at the turn of 12th to the 13th century AD, when the rumor - the so called infamia - was issued by papal decree to feign an ususally highly risky accusation. Embedded in two contradictory loyalities - one 'horizontal' to family and members of corporations and one 'vertical' to authorities -, in the then established inqusitorial trial, denunciation remained an ambivalent phenomenon, because it could serve as a tool to achieve reprehensible personal aims. Beyond its procedural function, but not indipendent of it, denouncing plays an important role in the development of an autonomous personality, and everyone can look back to the experience of 'primal treason' in his early life, as psychoanalytical research suggests.'
